While I'm willing to concede your point, I should also point out that of all the symbols of Christmas, the tree is the least Christian. It's a very recent add-on to the festivities compared to nativity scenes, which have been celebrated in Europe for a thousand years.
I doubt she would have sued if the display had included a nativity scene but no tree. However, I do see your point - if a Christmas tree is considered a Christian symbol, then she was just being an ass.
